Compliance documentation is held on file and is available on request. All other Equipment meets applicable mandatory Australian safety standards at the time of hire.

7.1 Safe sleep

Where porta cots are hired, you acknowledge that you have been directed to follow the safe sleep guidelines published by Red Nose Australia (rednose.org.au) and the safe sleeping guidelines of your relevant State health authority. Coast2Coast Baby Hire strongly recommends that all carers using hired porta cots familiarise themselves with these guidelines prior to use. A) If you discover a defect, fault, or safety concern with any item of Equipment during the hire period, you must notify us immediately by email. We will assess the issue promptly and, where the defect is genuine and was not caused by your use, we will arrange collection of the affected item without charge and offer either a replacement item (where available) or a pro-rata refund of the hire fee for the affected item for the remaining hire period.

B) You agree not to continue using Equipment that you have reason to believe is unsafe, and to keep it safely out of reach of children while awaiting collection.

Where a suitable replacement item is available, we will offer to supply it at no additional cost.

This is a standard insurance principle known as subrogation. We have no control over whether our insurer exercises this right. If you are concerned about this, you may wish to consider whether your travel insurance or other personal insurance provides any relevant cover.

D) To the fullest extent permitted by Australian Consumer Law, our liability to you for any loss or damage arising from the hire of Equipment is limited to the hire fee paid for the relevant booking. This limitation does not apply to liability for personal injury or death, liability arising from our own negligence or breach of these terms, or to any other liability that cannot be limited under the Australian Consumer Law. e)     We are not liable for any indirect, consequential, special, or incidental loss or damage arising from the use of hired Equipment, including but not limited to property damage or loss of enjoyment, except where such liability cannot be excluded under Australian Consumer Law.

Where the Australian Consumer Law applies, our liability is limited to the extent permitted by law, which may include (where permitted) re-supply of the services or the cost of having the services supplied again.

9. Late Returns and Failed Collection

A) If Equipment is not made available for collection at the agreed time, you will be charged an additional daily hire rate for each day the Equipment is retained beyond the agreed hire period. The daily rate is $15 per item per day, regardless of the original hire pricing tier.

This clause does not limit any other rights or remedies available to us under law.

Coast2Coast Baby Hire will not be liable for failure to deliver or collect Equipment due to circumstances beyond our reasonable control, including but not limited to severe weather events, natural disasters, flooding, road closures, or other force majeure events. In such cases, we will contact you as soon as practicable to reschedule and no cancellation fees will apply to either party. For the avoidance of doubt, any delay to collection caused by a force majeure event will not trigger the late return charges set out in clause 9.
